Alan Lawn is a litigator and bankruptcy lawyer with more than sixteen years of experience representing trustees, creditors, debtors, and other litigants in federal and state courts.  He began his career in the Financial Restructuring Group at Milbank LLP and then worked in the litigation and bankruptcy departments at Windels Marx Lane & Mittendorf, LLP, where his practice included representing the trustee recovering funds for investors defrauded by Bernie Madoff.

 

Alan’s experience includes:

  • Drafting complaints and briefs in complex cross-border fraudulent transfer actions, including briefing that resulted in a successful Second Circuit appeal and the denial of motions to dismiss.

  • Participating in the mediation of one such action, which resulted in a $35 million settlement.

  • Successfully arguing before the bankruptcy court concerning the relation back of newly asserted claims.

  • Managing and negotiating extensive cross-border discovery, including document requests, interrogatories, third-party subpoenas, and disputes involving foreign records.

  • Quickly developing command of numerous highly technical issues of civil procedure, bankruptcy law, securities law, and foreign law.

  • Serving as lead author of a Norton Annual Survey of Bankruptcy Law article on sections 501 and 502 of the Bankruptcy Code for several years.

 

Alan is a 2008 graduate of the New York University School of Law, where he won Best Oralist and Best Brief in the Orison S. Marden Moot Court Competition, and a 2005 graduate of Amherst College.

Alan is admitted to practice in New York and before the United States District Courts for the Southern and Eastern Districts of New York.
